1- OBJECT

The purpose of these General Conditions is to regulate the relationship between BANDE A PART, ESCUELA DE CINE SL, a company with registered office at Calle Noguera Pallaresa 61, 08014 – Barcelona, ​​incorporated for an indefinite period by public deed, and registered in the Barcelona Mercantile Registry, Volume 41146, Folio 192, Sheet number B 380576, 1st Entry and CIF number B-65048258, owner of the Non-Regulated Education Centre and Official Training Centre BANDE À PART, ESCUELA DE CINE (hereinafter, “BANDE À PART”) and You (hereinafter the BUYER), relating to the registration of the STUDENT in ONE COMPLETE COURSE (hereinafter, the COURSE) of any of the courses offered by BANDE À PART .

The contracting of the COURSE will be subject to the provisions of these General Contracting Conditions.

2- COURSE CHARACTERISTICS

The offer and all information relating to the Courses offered by BANDE À PART (characteristics, fees, curriculum, duration, entry requirements, course start, schedules, etc.) can be consulted on the website www.bandepart.org including official authorization codes for Vocational Training Courses, in www.bandeapart.org/professional-training  and their rates in www.bandeapart.org/cinema-courses-barcelona/

All information regarding the Courses has been made available to the BUYER and STUDENT prior to registration, including the start date and price, as well as these General Terms and Conditions. Both agree to be bound by the information received. For any questions, please contact us at tel. 93 444 76 78 and in the mail info@bandeapart.org.

BANDE À PART reserves the right to modify, adapt, or replace faculty, technical resources, facilities, or academic program content for the Course in which the student has enrolled, or even to cancel its start for any reason. If the Course cannot be started, BANDE À PART will notify the STUDENT with sufficient notice at the start of the COURSE and will refund the BUYER any payments made up to that point.

Likewise, for official courses, in the event of force majeure or regulatory changes, BANDE À PART may modify and adapt the Course in accordance with the authorities' requirements. Such changes will not entail any financial compensation for the BUYER.

3- ACCESS AND ADMISSION REQUIREMENTS

The STUDENT and the BUYER confirm that BANDE À PART has informed them of the access requirements to the Course and in the case of Courses belonging to an OFFICIAL VOCATIONAL TRAINING CYCLE, of the official requirements contemplated by current legislation (which can also be consulted on the official website of the ministry todofp.es at the following link: https:/www.todofp.es/como-cuando-y-where-to-study/access-vocational-training-from-vocational-training/how-do-I-access-vocational-training.html) and the documents required to prove them. In this case, the BUYER and the STUDENT declare that the STUDENT meets the official access requirements.

The BUYER and STUDENT agree to provide BANDE À PART with the required documentation during the registration process and no later than one month before the course start date. If registration occurs in the month prior to the start of the course, the documentation must be submitted within a maximum of five business days after registration.

General documentation required by BANDE À PART:

  • Photocopy of NIF/NIE
  • Passport-sized photograph of the STUDENT
  • Signed general contracting conditions
  • Bande À Part rules signed
  • Privacy Policy and Image Processing

Documentation also required for Official Vocational Training Cycle Courses:

  • Qualification that certifies access to the TRAINING CYCLE
  • For those with a degree in Spain: CERTIFIED photocopy of the official degree
  • For graduates from outside Spain, legalized foreign qualifications with an apostille (essential for registration), along with the certificate of approval in Spain
  • COMPLETE academic record of the most recent studies completed

In the event that the STUDENT does not provide the documentation required by BANDE À PART within the indicated period, BANDE À PART may terminate this contract, resulting in the STUDENT losing their place and registration on the Course and without the option of any refund or claim.

BANDE À PART reserves the right of admission, and may establish tests or academic criteria for admission to any of the Courses.

Programs carried out in collaboration with other institutions may require additional tests, interviews, or requirements and have a maximum number of places available, which will be assigned by BANDE À PART.

 

4- RATES (RRP) OF THE COURSE and TRAINING CYCLE

The fees for each course will be made available to the BUYER and the STUDENT prior to registration.

From the TOTAL PRICE per COURSE, the amount of the REGISTRATION FEE will be indicated in each case, which will be subtracted from the TOTAL PRICE.

In the case of Vocational Training Courses for Official Vocational Training, the Total Price of the Course will be the sum of the total prices of the TWO COURSES:

TRAINING CYCLE RATE = TOTAL PRICE FOR 1ST COURSE + TOTAL PRICE FOR 2ND COURSE

TOTAL PRICE FOR THE 1ST YEAR = REGISTRATION + FEES

TOTAL PRICE FOR THE 2ST YEAR = REGISTRATION + FEES

The applicable rates for the TOTAL CYCLE, REGISTRATION and FEE per COURSE of the current call can be consulted on the website www.bandeapart.org/cinema-courses-barcelona/ and are exempt from Value Added Tax – VAT.

 

5- REGISTRATION IN A COURSE

Registration for a course must be completed through our registration platform, accessible at: https://bap.dpsconsulting.es/registro/, by paying either the registration fee or the full amount of the course, depending on the payment method chosen.

For registration, the BUYER must complete their personal information and the required payment information, and the STUDENT must provide their personal information and the documentation required to access the course.

The STUDENT may complete his/her registration provided he/she meets the legal access requirements and provides the supporting documentation, as detailed in section 3. ACCESS AND ADMISSION REQUIREMENTS.

Once the registration process is complete, BANDE À PART will send the BUYER confirmation of the Course contract via a copy of this contract, within 24 hours to the email address indicated.

From the moment of ENROLLMENT, the STUDENT reserves a place on the COURSE and the BUYER assumes the commitment to pay for the ENTIRE COURSE, regardless of the agreed payment method.

If you enroll in an official vocational training course, as this is a place on an official qualification, BANDE À PART will register you in the public administration systems within the timeframes established by the authorities. You cannot replace your enrolled place if you withdraw once the course has begun. Enrollment in the course implies full compliance with each and every one of these General Conditions. Your acceptance will also be confirmed by checking the box provided for this purpose in the online enrollment system.

Any service subsequently offered by BANDE À PART must be contracted again.

BANDE À PART reserves the right to grant admission by modules and may establish admission criteria such as the minimum number of modules, the student's record, the number of places in the course, or others.

In the event that a Student wishes to take a single module of a Vocational Training Course and BANDE À PART accepts their registration, they will be informed of the price of the Module to which the Course Registration Fee will always be added.

The fee per module will be applicable for modules that may be REPETITED or RECOVERED for BANDE À PART STUDENTS who do not pass any module of a COURSE.

 

6- DISCOUNTS, PROMOTIONS AND SCHOLARSHIPS

BANDE À PART reserves the right to determine (and modify without prior notice, at its own discretion) the application, duration, number of places, and amounts of any discounts, promotions, or financial assistance in the form of discounts for any of the Courses. It also reserves the right to apply specific promotions, discounts, or assistance to certain groups and to establish their conditions of access.

When the STUDENT/BUYER requests information, BANDE À PART will inform him/her of the discounts, grants or promotions applicable at that time on the Ordinary Course Fees, as well as their validity period.

If registration is made outside the promotional period or the available quota of places has been exceeded, BANDE À PART reserves the right to maintain it or apply the conditions in force at that time.

The price of the regular rate and the price with any discount or promotion applied will be notified to the BUYER during the registration process on the Platform. Once registration is complete, all financial conditions of the registration can be viewed on the Platform/Student Portal/Registration.

The Offer price, with a discount, promotion or bonus compared to the Regular Rate, is only applicable to the Course for which the STUDENT/BUYER is enrolling and does not imply the maintenance of the offer for subsequent Courses.

The rate accepted by the BUYER/STUDENT at the time of enrollment cannot be modified. If the student's conditions change during the course for any reason, these new conditions cannot be applied to the rate for which they have already enrolled. Changes will not be retroactive and will not affect any rate changes once the enrollment conditions have been accepted.

For the following courses, the Regular Rate will apply, except in cases where discounts, promotions, or bonuses are offered during specific periods or for specific reasons. Students/buyers will always be informed of any special offers available to renew their registration.

The fact that the STUDENT is applying for a scholarship external to BANDE À PART (not reflected as a discount on the tuition fee) does not exempt the BUYER from the payment obligation, even if it is awarded and paid directly to the Center by the issuing entity. If the student is awarded the scholarship, BANDE À PART will reimburse the BUYER the amount received from the issuer without undue delay, provided that the BUYER is up to date with payments as of the award date.

 

7- PAYMENT METHOD

The default payment method for the course is the payment of the full amount in advance before the start of the course (SINGLE PAYMENT). Payment can be made by bank transfer to BANDE À PART or by credit card.

BANDE À PART may grant the BUYER the option of deferring payment of the Course fee using the DEFERRED PAYMENT IN INSTALLMENTS modality, except for the REGISTRATION fee, which will be paid in full in a single payment, essential to reserve the place.

DEFERRED PAYMENT IN INSTALLMENTS

Payment of the total amount of the course will be distributed:

  • An initial payment for the REGISTRATION fee is required to complete the registration process and reserve a spot.
  • A series of monthly payments or installments until the total amount of the course is completed.

Payment for the REGISTRATION fee must be made by bank transfer to BANDE À PART or by credit or debit card, and subsequent payments (installments) must be made by direct debit (Spanish account), credit or debit card, Bizum, or bank transfer. In the case of payment by transfer, the BUYER is required to upload the receipt to the Platform or send it to us by email at the time of payment to the address administration@bandeapart.org.

The BUYER assumes that, in the event of non-payment of two or more installments, consecutive or not, BANDE À PART may permanently cancel the STUDENT'S registration from the Course or until the payment situation is regularized.

BANDE À PART will receive the net (TOTAL) amount of the Course. Therefore, if the payment method used by the BUYER incurs any type of bank fee, discount, or other expense, the BUYER must pay this fee in addition to the Course fee. Likewise, receipts or payments returned for reasons inherent to the BUYER will be increased by the costs incurred in returning them.

By confirming the Enrollment and paying the REGISTRATION FEE, the BUYER authorizes BANDE À PART to charge the successive agreed payments to the indicated bank account. He/she also authorizes BANDE À PART to communicate the personal data provided to the bank in order to manage the direct debit of the payments that are due due to the STUDENT'S registration.

In accordance with applicable data protection regulations, BANDE À PART informs the BUYER that, in the event of a request for DEFERRED PAYMENT IN INSTALLMENTS, BANDE À PART may consult credit information systems in order to obtain information available about the BUYER in the common files and assess their solvency to determine the risk with respect to the requested payment deferral. This consultation is carried out exclusively automatically and, based on the information obtained, BANDE À PART will decide on the granting or, where appropriate, the automatic denial of the requested payment deferral. The BUYER has the right not to be subject to this type of decision; however, and given that the aforementioned consultation of the common files is necessary for the granting of the deferral requested by the BUYER, if they oppose the processing of their data for this purpose, BANDE À PART will not be able to assess the granting of the deferral or, therefore, grant it.

 

8- REQUESTS FOR DISCHARGE

The request for withdrawal must be made in writing and may be submitted by the STUDENT or the BUYER in person at our center or by email to the address administration@bandeapart.org .

In the event of a STUDENT'S withdrawal, BANDE À PART undertakes to provide the STUDENT'S academic record within a maximum period of 15 working days once the withdrawal has been processed for any reason.

8.1- REQUEST FOR WITHDRAWAL BEFORE THE START OF THE COURSE

If the STUDENT requests withdrawal from the COURSE at most 14 days before its start date (published on the BANDE À PART website), the BUYER will be refunded the amounts paid with the exception of the REGISTRATION amount of the Ordinary Course Fee.

BANDE À PART will refund the TOTAL amount paid, except for a fixed fee of €300 for administrative procedures, if any of the following circumstances are documented:

  • Serious illness certified by a medical certificate that prevents the STUDENT from taking the Course.
  • Forced change of residence of the STUDENT or his/her family unit, for accredited reasons or force majeure (not applicable to ONLINE training).
  • For foreign graduates, the denial of a student visa by the Spanish authorities.

And also, in particular for students of a VOCATIONAL TRAINING CYCLE COURSE:

  • Not having passed the exams that allow obtaining the qualification for access to the OFFICIAL VOCATIONAL TRAINING CYCLE.
  • The denial of homologation of a qualification for access to the TRAINING CYCLE.

8.2- REQUEST FOR WITHDRAWAL ONCE THE COURSE HAS STARTED

If the STUDENT requests withdrawal from the COURSE, abandons it or terminates this contract after the start date of the COURSE (whether or not he/she has attended the course), the BUYER cannot recover the amounts paid to BANDE À PART and is not exempt from the obligation to pay the total amount of the course.

BANDE À PART will only waive the outstanding debt corresponding to the deferred installments pending payment from the date of the cancellation request (in the case of deferred payment) or the equivalent amount in the case of cash payment, if any of the following circumstances are documented:

  • Serious illness certified by a medical certificate, which prevents the STUDENT from continuing the COURSE.
  • Change of address forced of the STUDENT or his/her family unit, for accredited reasons or force majeure (not applicable to ONLINE training).
  • Resolution denying the homologation of access qualifications in the case of TRAINING CYCLE Courses.

In the case of cash payment, the amounts already paid, except for the REGISTRATION fee for the Regular rate and the monthly payments already paid, may be applied to the payment of another Course in Bande À Part within the two years following the interrupted academic year.

Under no circumstances will the amounts paid be refunded and no other STUDENT may benefit from said amounts.

 

9- RECOGNITION / VALIDATION OF MODULES AND POSSIBLE REFUND 

The STUDENT may request validation and/or recognition of modules according to the following procedure:

MODULE RECOGNITION

For those professional modules that have the same codes, names, terminal capacities or learning outcomes, content and duration, they will be considered identical modules.

You can apply by submitting all the documentation at the time of registration.

MODULE VALIDATIONS

For those professional modules completed in other studies.

They can be requested once the course has started on the dates that will be communicated by the center's academic secretary and published on the BANDE À PART Campus.

Validation modalities according to official regulations (https://www.todofp.es/convalidaciones-equivalencias-homologaciones/convalidaciones.html)

  • Direct validation: modules whose validation is the responsibility of the center.
  • Individual validation: modules whose validation corresponds to the Ministry of Education or the Department of Education.

APPLICABLE FEES AND REFUNDS

The fee applicable to recognized/validated modules will be the fee per module. If the amount of the modules to be recognized/validated is greater than the total discounts applied to the COURSE, the BUYER will be refunded the resulting difference. Otherwise, having benefited from a discount greater than the amount corresponding to the recognized/validated modules, the STUDENT may recognize/validate the modules and will be exempt from their assessment, but no refund will be made to the BUYER.

 

10- WITHDRAWAL

The BUYER shall have a period of fourteen calendar days from the date of COURSE ENROLLMENT to terminate the contract and cancel the contracted Course without providing any justification. If the BUYER withdraws within this period, all payments received will be returned without undue delay and, in any case, no later than 14 calendar days from the date on which the BUYER notifies us of their decision to withdraw from this contract. BANDE À PART will process said refund using the same payment method used by the BUYER for the initial transaction.

To exercise the right of withdrawal, the BUYER must notify BANDE À PART by email to the address administration@bandeapart.org, your decision to withdraw from the contract, using the form attached in Annex 1.

However, if the Course covered by this contract begins before the end of the withdrawal period (i.e., if the Course starts less than 14 days after Enrollment), by this contract you accept the loss of your right of withdrawal.

In the case of ONLINE Courses, the provision of the teaching service covered by the contract will begin when the student has accessed the content on the Virtual Campus or has been sent some type of material.

If the course is IN PERSON, the date that will be taken into account is the one published for the START OF THE COURSE on the Web www.bandeapart.org , whether or not you have attended classes.
